These Terms of Service (“Terms”) govern your access to and use of this website and any purchases made through it. By accessing or using our website, or by placing an order, you agree to these Terms.

2. Eligibility and Accounts
You must be legally able to enter into a contract to use this website and purchase products.
If you create an account, you are responsible for maintaining the confidentiality of your login details and for all activities under your account.
3. Products and Information
We sell natural gemstones and related products. Gemstones vary naturally and may contain inclusions, growth features, and other characteristics typical of natural material.
Photos and Appearance: We aim for accuracy, but color and appearance may vary due to lighting, camera settings, and your screen/device.
Measurements: Measurements and weights are stated as accurately as possible.
4. Product Lines
Gem-Fountain offers two distinct product lines:
Classic & Fine Gems: Curated stones finished/refined for beauty and performance.
Market Direct & Wholesale: Lots/parcels and rough goods sold "as traded." Cutting quality may vary, and native cuts are common.
5. Pricing and Orders
Currency: Prices are shown in USD or EUR and may change without notice. The price shown at checkout is final for that order.
Order Acceptance: Placing an order is an offer to purchase. We may decline orders at our discretion due to payment issues, shipping restrictions, or compliance. If declined, we will contact you and provide a refund.
6. Payment Methods
Standard: We accept Stripe and PayPal. Stripe may include Apple Pay, Google Pay, or WeChat Pay depending on your location.
Bank Transfer (Wise)
Items are reserved for 72 hours.
If payment is not received within 72 hours, the order may be cancelled.
Bank transfer orders may qualify for "wire pricing" discounts where stated.
7. Shipping
Origin: We ship worldwide from Chanthaburi, Thailand using tracked services.
Processing: Orders are typically processed within 1 business day (Mon–Fri), excluding Thai public holidays.
Customs and Duties: International shipments may be subject to customs duties, VAT, or brokerage fees. These are the buyer’s responsibility.
Undeliverable Packages: If a package is refused due to unpaid duties, a 10% restocking fee plus return freight and customs costs may be deducted from your refund.
8. Returns and Refunds
Return policies differ by product line:
Classic & Fine Gems
May be returned within 14 days of delivery.
Must be unused, unchanged (no setting/recutting), and in original packaging.
Shipping fees are generally non-refundable.
EU Customers: We may offer a return address via our partner, Top-Gems (Austria). Contact us first for instructions.
Market Direct & Wholesale
These items are final sale.
Exceptions are made only for shipping errors or verified transit damage.
You must notify us within 48 hours of delivery with photo/video evidence.
9. Professional Use
By purchasing Market Direct items, you acknowledge they are intended for professional buyers who understand "as traded" conditions, and that additional work (sorting or recutting) may be required.
10. Legal Terms
Prohibited Use: You may not misuse the website, attempt unauthorized access, or use the site for unlawful purposes.
Intellectual Property: All content (text, images, logos) is owned by Gem-Fountain and requires written permission for use.
Liability: Our total liability for any claim is limited to the amount paid for the item in question.
Governing Law: These terms are governed by the laws of Thailand. Disputes will be handled in Thai courts unless mandatory local consumer laws dictate otherwise.
